Cape Town Spurs have officially withdrawn their High Court application against Durban City, effectively ending their legal challenge over the promotion of the KwaZulu-Natal-based side to the Premier Soccer League (PSL).
The legal battle, which centred around the eligibility of Durban City midfielder Saziso Magawana, has now been concluded with Spurs pulling out of the courtroom fight. This decision clears the way for Durban City to take their place in the top flight for the 2025/26 season.
Legal Drama Comes to an End
Spurs had initially contested Magawana’s registration status, believing the player was ineligible. However, their protest was dismissed by both the PSL’s Dispute Resolution Chamber (DRC), chaired by Raymond Hack, and the SAFA arbitration panel, which ruled in favour of Durban City.
Following those setbacks, the Cape side escalated the matter to the High Court, hoping to overturn the arbitration decision and halt Durban City’s promotion. But in a dramatic turn, they have now withdrawn the application and ended all legal proceedings.

Durban City can now proceed with their preparations for life in the Betway Premiership without any legal cloud hanging over their promotion. The PSL is also expected to finalise all outstanding matters related to league promotion and prize handovers.
As for Cape Town Spurs, the club faces the harsh reality of relegation to the ABC Motsepe League. However, reports suggest they may be exploring alternative options, such as purchasing another club’s franchise, in a bid to remain in professional football.
